Terms and Conditions of Use | Cinque Terre Trip

1. Introduction

Welcome to Cinque Terre Trip (hereinafter the “Site”), available at https://www.cinqueterretrip.info.

These Terms and Conditions of Use (hereinafter “Terms”) govern access to and use of the Site by users. Accessing, browsing, and using the content published on the Site constitutes full and unconditional acceptance of these Terms. If you do not wish to accept these Terms, in whole or in part, you are invited to stop using the Site.

The Site is managed by Cinque Terre Trip, as the Data Controller.

2. Definitions

For the purposes of these Terms:

• Site: the Cinque Terre Trip web platform available at https://www.cinqueterretrip.info.
• Owner: Cinque Terre Trip, owner and operator of the Site.
• User / Visitor: any natural or legal person who accesses, browses, or consults the content available on the Site.
• Content: all texts, articles, guides, graphic elements, logos, source code, images, photographs, and informational material published on the Site.

3. Purpose

The Site is exclusively informational, educational, and cultural in nature, dedicated to the tourism promotion of the Cinque Terre.

The Site publishes editorial articles, travel tips, practical guides, itineraries, and news about villages, beaches, trails, trekking, accommodation (hotels, apartments), dining, transport, and local events. The Site is not a news publication, a travel agency, or a tour operator, and does not provide direct sales or intermediary services.

4. Scope of Application

These Terms apply to all Users who access and use the Site.

The Site is purely informational in nature. The Site does not include features that allow Users to:

• Register or create a user account;
• Log in;
• Publish content, articles, comments, or reviews;
• Upload files or images;
• Directly purchase products, services, tickets, or accommodation;
• Carry out transactions or payments of any kind.

5. Use of the Site

The User agrees to use the Site and its Content exclusively for lawful, personal, and non-commercial purposes, in compliance with applicable Italian and European law.

Access to the Site is free of charge. The User is solely responsible for the availability, configuration, and security of the IT tools (browser, internet connection, device) used for browsing.

6. Intellectual Property

All Content on the Site — including, by way of example and without limitation, texts, page structure, source code, graphics, trademarks, logos, and colour combinations — is the exclusive property of the Owner or of third parties who have authorised its use, and is protected by Italian and international laws on copyright and intellectual property (Italian Law no. 633 of 22 April 1941, as amended).

Any reproduction, modification, duplication, sale, distribution, or commercial exploitation of the Site’s Content without prior written consent from the Owner is strictly prohibited.

Any trademarks, logos, trade names, or service marks belonging to third parties mentioned on the Site remain the exclusive property of their respective owners.

7. Image and Content Licences

The photographs and visual elements on the Site come from the following sources:

1. Original photographs: taken and processed directly by the Owner, who holds the relevant copyright and exclusive rights.
2. Unsplash images: photographs distributed through the Unsplash platform. These images are used in accordance with the official Unsplash License, which permits free reuse for commercial and non-commercial purposes. The relevant copyrights remain with the respective authors.
3. AI-generated multimedia or graphic content: used to support the visual design of the Site.

Should any party believe that visual content published on the Site infringes their copyright or intellectual property rights, they are invited to notify the Owner promptly via the contact details provided in the “Contact” section. The Owner will carry out the appropriate checks and, if necessary, promptly remove the contested element.

8. Accuracy of Information

The Content published on the Site is prepared with the utmost care and diligence for purely informational and tourist guidance purposes. However, due to the continuously evolving nature of local, seasonal, and regulatory data:

• The Owner does not guarantee the absolute completeness, accuracy, timeliness, or real-time update of the information provided.
• In particular, information subject to frequent changes such as: train and bus timetables, ferry timetables and routes, trekking trail conditions, weather conditions, entrance or accommodation prices, events, exhibitions, restaurant and hotel openings is for indicative purposes only.

Users are required to always verify the accuracy and currency of information through official sources and channels (e.g. Trenitalia, Cinque Terre National Park, local municipalities, ferry companies, official accommodation facilities) before travelling, purchasing tickets, or making logistical decisions.

9. Site Availability

The Owner will endeavour to keep the Site continuously accessible and operational. Nonetheless, the Site or certain sections thereof may be temporarily unavailable or experience slowdowns due to:

• Periodic scheduled or unscheduled maintenance;
• Technical, software, or infrastructure updates;
• Failures or malfunctions of the internet network, hosting infrastructure (Vercel), or servers;
• Force majeure events, unforeseeable circumstances, or events otherwise beyond the Owner’s control.

The Owner disclaims all liability for any damages or disruptions resulting from the temporary inability to access the Site.

10. Links to Third-Party Websites

The Site contains or may contain hyperlinks to external websites, platforms, or resources managed by third parties (for example, the Site’s official Instagram profile page).

Such links are provided solely for the convenience and reference of the User. The Owner exercises no control over external sites, their content, their privacy policies, or their general terms of sale or use.

The presence of a link to a third-party site does not imply endorsement, guarantee, or recommendation by the Owner. Any User who chooses to visit an external site via a link on Cinque Terre Trip does so at their own risk and is responsible for consulting the terms of use and privacy policies of that site.

11. Affiliations (future provision)

The Site does not currently include active commercial affiliate links or tools.

Users are nonetheless informed that, in the future, the Site may integrate commercial affiliate links or widgets pointing to external booking platforms (including, by way of example and without limitation: Booking.com, GetYourGuide, or similar services).

In the event of future integration:

• Affiliate links will allow Users to book accommodation or activities directly on official partner sites;
• Such links will be clearly identified in accordance with applicable advertising transparency regulations;
• Any purchase will take place directly and exclusively on the third-party partner platforms, under their own contractual terms, at no additional cost to the User and without the Owner assuming the role of a contracting party in the transaction.

12. Limitation of Liability

To the maximum extent permitted by applicable Italian law, the Owner shall not be held liable in any way for:

1. Any inaccuracies, errors, omissions, or delays in updating tourist, logistical, or practical information published on the Site.
2. Direct, indirect, incidental, or consequential damages (including, by way of example, travel delays, unexpected expenses, cancellations, lost earnings, or missed opportunities) arising from the User’s reliance on the Site’s Content.
3. Travel decisions, bookings, or purchases made by the User with third parties or external sites.
4. Malfunctions, service interruptions, malware infections, or technical issues occurring on the User’s device during or following use of the Site.

13. Prohibited Uses

Users are strictly prohibited from carrying out the following actions on the Site or through its infrastructure:

• Using bots, spiders, scrapers, crawling tools, or any other automated process to access, extract, copy, or index the Site’s Content or code (unauthorised data mining / content scraping);
• Carrying out reverse engineering, decompilation, or disassembly of the Site’s source code;
• Attempting to breach or circumvent the security measures of the Site, its servers, or connected networks (e.g. DoS/DDoS attacks, vulnerability scanning);
• Systematically copying, reproducing, or republishing articles or sections of the Site on other web or print platforms without written authorisation;
• Using the Site for unlawful, fraudulent, deceptive, or public order-violating purposes.

The Owner reserves the right to take legal action and report to the competent authorities any harmful or unauthorised conduct.

14. Protection of Content

The Site and its editorial project constitute a protected database pursuant to Italian Legislative Decree no. 169 of 6 May 1999 and copyright law.

Any use or quotation of brief extracts from the Site’s articles for the purposes of news reporting, criticism, or discussion is permitted exclusively on the condition that it is accompanied by a clear attribution to the source “Cinque Terre Trip” and an active, functional link to the original page of the Site (https://www.cinqueterretrip.info).

15. Privacy and Cookies

The processing of personal data of Users who visit the Site is carried out in full compliance with EU Regulation 2016/679 (GDPR) and applicable Italian law.

17. Governing Law

These Terms and Conditions of Use are governed by and shall be interpreted exclusively in accordance with Italian law.

Without prejudice to any mandatory consumer protection provisions (where applicable), any dispute arising in connection with the interpretation, validity, effectiveness, or performance of these Terms or the use of the Site shall be subject to Italian jurisdiction and the competent court established by applicable law.
